These Terms of Service ("Terms") govern your use of thelommy.com (the "Site") and any purchase you make from it. The Site is operated by Carré d'AS LLC, a Wyoming limited liability company, trading as "Lommy" ("Lommy", "we", "us", "our"). By using the Site or placing an order, you agree to these Terms, our Refund & Return Policy, Shipping Policy and Privacy Policy, which form part of these Terms. If you are a consumer in the United Kingdom, nothing in these Terms affects your statutory rights.

1. Eligibility

You must be at least 18 years old to purchase from the Site. By placing an order, you confirm that you are 18 or older and that the information you provide is accurate and complete.

2. Products and health information

Lommy products are food supplements (dietary supplements). They are not medicines and are not intended to diagnose, treat, cure or prevent any disease. Food supplements should not be used as a substitute for a varied, balanced diet and a healthy lifestyle. Do not exceed the recommended daily dose. Always take with at least 250 ml (8 fl oz) of water — products containing psyllium may cause choking if taken without enough liquid, and should not be taken by people with difficulty swallowing. Consult a doctor or healthcare professional before use if you are pregnant, breastfeeding, taking medication (fibre may affect the absorption of medication — separate intake by at least 2 hours), have a medical condition, or are under medical supervision. Keep out of reach of children. Stop use and consult a doctor if you experience any adverse reaction.

3. Orders and contract

Your order is an offer to buy. A contract is formed only when we dispatch your order and send you a shipping confirmation. We may refuse or cancel any order, in whole or in part, at our discretion, including where a product is unavailable, where there is an error in price or product description, where we suspect fraud, resale or unauthorised activity, or where the order does not meet our verification checks. If we cancel an order after payment, we will refund the amount paid in full. We may limit quantities per customer, household, address or payment method.

4. Prices and payment

Prices are displayed in the currency of your market and may change at any time before your order is placed. UK prices include VAT. We accept the payment methods displayed at checkout. Payment is taken at the time of order. Charges will appear on your statement as LOMMY. In the event of an obvious pricing error, we are not obliged to supply products at the incorrect price.

5. Promotions and bundles

Promotional offers, discount codes and bundle offers (such as "Buy 2, Get 1 Free") are subject to availability, cannot be combined unless stated, have no cash value, and may be withdrawn at any time. Free units are conditional on the purchase of the full bundle (see our Refund & Return Policy).

6. Delivery, returns and refunds

Delivery is governed by our Shipping Policy. Cancellations, returns and refunds are governed by our Refund & Return Policy.

7. Payment disputes and chargebacks

You agree to contact us at support@thelommy.com and allow us a reasonable opportunity to resolve any issue with your order before initiating a chargeback or payment dispute. When you place an order, you authorise us to share with the payment provider and your card issuer any information relevant to the transaction, including order details, IP address, device information, delivery and tracking records, and communications with you, in order to respond to a dispute. Where a chargeback is found to be unfounded, we may recover the disputed amount and associated fees and refuse future orders. Nothing in this section limits the statutory rights of UK consumers.

8. Reviews and user content

If you submit reviews, photos, videos, comments or other content ("User Content"), you grant us a worldwide, non-exclusive, royalty-free, perpetual licence to use, reproduce, edit, publish and display it in connection with our business and marketing, with attribution by first name and initial or anonymously. You confirm that your User Content is truthful, is your own, and does not infringe anyone's rights. We may moderate, edit for length or remove User Content that breaches these Terms, but we do not suppress genuine negative reviews.

9. Intellectual property

All content on the Site, including the Lommy name, logos, packaging, text, images, videos and design, is owned by or licensed to Carré d'AS LLC and protected by intellectual property laws. You may not copy, reproduce, distribute or use it for commercial purposes without our prior written consent.

10. Prohibited use

You may not use the Site for any unlawful purpose, to place fraudulent orders, to resell products without our authorisation, to interfere with the Site's security or operation, or to scrape or collect data from it.

11. Limitation of liability

To the fullest extent permitted by law, the Site and products are provided "as is" and "as available", and we disclaim all warranties not expressly stated in these Terms. We are not liable for any indirect, incidental, special, consequential or punitive damages, or for loss of profits, data or goodwill, arising from your use of the Site or products, including any use contrary to the directions and warnings on the label or on the Site. Our total liability for any claim relating to an order is limited to the amount you paid for that order.

United Kingdom consumers: nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for breach of your rights under the Consumer Rights Act 2015, or for any other liability that cannot be excluded or limited by law. We are responsible only for loss or damage that is a foreseeable result of our breach of these Terms. We supply products for domestic and private use only.

12. Indemnity (United States)

If you are located in the United States, you agree to indemnify and hold harmless Carré d'AS LLC and its members, officers and agents from any claims, losses and expenses (including reasonable attorneys' fees) arising out of your breach of these Terms, your misuse of the products, or your violation of any law or third-party rights.

13. Governing law and disputes

United States customers — arbitration and class action waiver

Please read this section carefully; it affects your legal rights. Before filing any claim, you agree to first contact us at support@thelommy.com with a written description of the dispute and attempt to resolve it informally for at least 60 days. If the dispute is not resolved, it shall be resolved by final and binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court, except that either party may bring an individual claim in small claims court. You and Lommy each waive the right to a jury trial and to participate in a class action, class arbitration or representative proceeding. The arbitration will be held remotely or in the county where you reside. You may opt out of this arbitration agreement by emailing us within 30 days of your first purchase with the subject "Arbitration Opt-Out". These Terms are governed by the laws of the State of Wyoming and applicable U.S. federal law, including the Federal Arbitration Act, without regard to conflict-of-law rules. If the class action waiver is found unenforceable, this arbitration section shall be void in its entirety.

United Kingdom customers

These Terms are governed by the laws of England and Wales. You may bring proceedings in the courts of England and Wales, or, if you live in Scotland or Northern Ireland, in the courts of your home nation. The arbitration and class action waiver above do not apply to UK consumers. We encourage you to contact us first so we can try to resolve any complaint quickly.

14. Changes and severability

We may update these Terms at any time by posting the revised version on the Site. The Terms in force at the time you place your order apply to that order. If any provision is found invalid or unenforceable, the remaining provisions remain in full force.
